SINGAPORE: The Commercial Affairs Department (CAD) has launched investigations into multi-level marketing (MLM) firm, Sunshine Empire.
The probe by the white collar crime buster comes just over a month after the Monetary Authority of Singapore (MAS) placed the firm on an investor-alert list which zooms in on those who may be conducting activities regulated by the MAS without authority.
Sunshine was also put on a similar list by Malaysian authorities a few months ago.
MLM firms, which are legal in Singapore, typically invite people to pay cash for the right to market goods to other people. They also get cash for recruiting other MLM marketeers.

What do I know?
I got to know Sunshine Empire through a friend few months back and according to him, he earns quite alot through the investment plans. The investment plans earns him much much more than what any local bank’s investment plans can give. I’m going to stop here about what I know – I’ve got no facts since it’s a ‘hear-say’.
Whats wrong?
Just think. You think investing $20k and you’re getting back $40k in a year without having to do any work? Nothing is free, my dad always says.
Even if stock markets are bullish right now, it’s near to impossible for anyone to just invest for you and get back so much. Hey, do you know how many hedge funds went bankrupt last and this year?
Is this publicity or bad news for the company?

I am NOT an investor of Sunshine Empire. Neither am I a supporter of the company. And, I’m not having anything against the Empire (Why should I?).
Investors may want to get back what they invested few months back, but I’m quite sure that the company wouldn’t allow that. If everyone does that, they’ll close down soon. So good luck guys.

At least banks are more reliable with their lower but realistic interest rate at maybe 4% per annum.

Thanks Rolando for exposing the plot by one man to bring down a great company like Winwinzone Phils. Inc and we all know that guy is Gary Leoncio. I heard from the Council Members why Gary is unhappy based on the these events and without prejudice to anyone, these are all facts and you be the judge;
1. On Sept 26, 2010 – Gary ALONE took ALL the Profit Share of the Council Slots amounting to millions (this was witnessed by thousands of people at the Grand launching);
2. In the 1st Council Meeting in early Nov., 2010 – Gary alone took 50% Share of the Profit Share of the Council and gave the remaining 50% to be shared by the remaining 9 Council Members;
3. At the 2nd Council Meeting, the Council Members requested Sir James to take back the role of country stockistship (as there were many complaints about Mrs Miernie Leoncio’s being very proud and rude to the Distributors & Stockists. Sir James agreed and Gary also agreed during the 2nd Council meeting to hand over but the date of handing over was not fixed. No promise was ever made by Sir James to Gary at any time regarding the exclusivity of Stockistship to be handled by Gary in the Philippines.
4. Sir James requested Gary to share the next Council’s Profit Sharing to be fair to all the other top leaders of Winwinzone Phils Inc and Sir James reminded also to Gary regarding the Stockistship handing over to the Company.
5. Because of these 2 incidents ie. sharing of Council’s Profit Share & returning the stockistship to the company, Gary started his attacks on Sir James and Winwinzone Phils Inc. It all started at ASYA Performers’ Treat Dec 18, 2010 when Mrs Miernie Leoncio walked out as Sir James were about to make his speech in front of all the performers. This was followed by numerous private discussions by Gary with top leaders of the company with many text blasts all to discredit Sir James & Winwinzone Phils. On Jan 3, 2011, during the Council meeting, Gary again attacked Sir James with harsh words and rude behavior. Witnessed by all Council members who were shocked at his behavior, even Sir James tried to calm him down. After that meeting, Gary continued with his threats & schemes all designed to bring down Winwinzone & Sir James.
All these resulted in Gary’s suspension in early January, 2011.
All the Council members and leaders have decided to continue with Winwinzone despite Gary’s attempts to discredit the company & Sir James because they believe in Sir James and Winwinzone. This frustrates Gary and in his desperate attempt, he resorts to threatening complaints to BIR to destroy Winwinzone.
Winwinzone has always issued Official receipts to all our distributors ever since they took over as Country Stockist but unfortunately Mr Gary Leoncio/ Mrs Miernie Leoncio via their company 4&1 Global Markets Inc never issued Official Receipts during their role as country stockist for the entire 2010, perhaps someone should report them to the BIR instead! We also wonder if Gary Leoncio reports his income to BIR.
Sir Gary, you have already earned and profited so much with Winwinzone, unlike others. So many Filipino livelihoods depend on Winwinzone.
For the sake of many people, please move on with your life. You call yourself a Pastor but your actions depicts more like a man possessed by the devil.
You have already text blasted your resignation from Winwinzone on January 8, 2011 and on this blog on Jan 10, 2011. If you are unhappy, appoint a good lawyer and sue Winwinzone. There is a proper time and place for everything.

As a retired lawyer, one of the basic principles taught in law schools is confidentiality. I am not sure how Atty. Mario Rellora was giving comments about her clients problems in blogs like this, unless perhaps he is not really an Attorney! Furthermore, if you are a litigator, u will not make a warning in public but proceed straight into legal action. Something fishy is going on here….

I was invited twice in Lipa Batangas where they conduct BOM’s. I invested P20,250 thinking that it would generate interest or monthly profit share as they promised but until now I only got 31 ringgits or Php418.50 since October. Very nice investment huh.. He was sentenced to 9 years imprisonment and fined $60,000.
c. Neo Kuon Huay was convicted on all charges involving the falsification of Sunshine Empire’s accounts under the Penal Code. She was sentenced to a fine amounting to S$60,000.
d. Yong Wai Hong had pleaded guilty to all charges of false declaration of the share capital of various companies under the Companies Act. He was convicted and has been sentenced to a fine amounting to S$24,000.

didn’t realise ppl still discussing this thing. i have totally forgot about until i saw the 150$ company magazine at my shoes tray that terry gave which he claimed he paid for it and brought it all the way to sarawak.
when come to think of it, he did really work hard for his 1st offline promoting project after all his online investment falled. he was then came here with david tan, terry tan’s guidance, i wonder how he is? i guess from sound of it, terry has surpassed him. during then, only david do the talking, terry is just there to listen.

彭华被控失信及以欺骗手法营业案昨天开审，控方指出，阳光大帝从售卖配套取得超过1亿8000万元，虽然约1亿1800万元分发给参与者，以鼓励他们购买更多配套，并吸引其他人考虑加入，不过，大部分的钱落入彭华及他的追随者，尤其是彭华本人牟取了至少500万美元（约710万新元）顾问费和津贴。
而且，控方指阳光大帝必须年年赚取349%盈利，才能维持业务，但那毫不合理，最终将损害后来加入者的利益。
现年49岁的彭华、梁君花（46岁）及何俊杰（29岁）今年2月3日被控，彭华面对最多控状，共20项，其次是何俊杰10项，梁君花七项。
彭华面对的其中14项控状，指他触犯刑事法典，包括8项教唆何俊杰失信94万7000多元，6项与梁君花共谋作假账。他也面对一项以欺骗手法营业，触犯公司法令控状。其余5项则是触犯公司法令及影片法令的控状。
何俊杰除了被控协助彭华失信外，还面对多两项控状，包括以欺骗手法营业以及未确保公司账目清楚，抵触公司法令控状。梁君花除了被控与彭华共谋作假账外，则面对多一项向商业注册局呈报假资料，触犯公司法令控状。
彭华昨早9时左右来到初庭，神情轻松。控方以彭华、何俊杰及梁君花面对的抵触刑事法典和那项以欺骗手法营业控状都有关联，向法官提出联合审讯申请，获得批准。
主控官艾迪阿都拉副检察司在开庭陈词时指彭华和何俊杰以欺诈方式售卖高回报配套。 主控官说，阳光大帝并没有经营实质有盈利的生意，也没实质资金支付参与者高回报，他们清楚如果没有新资金投入，公司无法持续支付高回报。
控方将证明如果没有新资金投入，参与者迟早一分钱都拿不回。
彭华得公司百万元免息贷款助解决个人债务
此外，阳光大帝提供彭华100万元免息贷款，协助他以前的公司解决银行和税务债务。这些公司目前已停止营业。控方将证明阳光大帝提供至少4000万元无抵押免息贷款给生意伙伴。
针对刑事法典的控状，主控官指彭华、梁君花及何俊杰共谋以不法和不诚实的手段致富。 主控官说，控方将证明彭华要何俊杰委任梁君花为集团营业董事，让梁君花自动获得相等于公司1%净营业额的款项，犯下失信罪。公司8次支付梁君花约94万7000多元的“销售奖励”，为了掩盖事实，梁君花和彭华6次共谋作假账。
控方将传召21名证人，包括来自英国伦敦的专家证人卢克·斯特德曼、14名参与者以及阳光大帝的会计员供证。卢克·斯特德曼是特许会计师，也是法证专家。
主控官指出，控方的专家证人将证明阳光大帝的计划在任何合理情况下，都不可能持续。 他说，根据专家证人的意见，公司付给参与者的回报，并不是来自实在的生意盈利，而是新加入者投入的资金。专家证人的分析显示，阳光大帝每年须赚取349%盈利，才能维持业务。公司支付参与者的回报不实际，无法持续，最终将损害后来加入者的利益。
控方传召的14名参与者来自不同背景，他们将证明受高回报吸引加入计划，而阳光大帝夸大其词，声称公司及相关公司拥有或管理的海外计划都很成功，使他们相信公司有能力支付高回报。

2)I am an experience full time trader, I trade futures, forex and commodity MANUALLY. You will not scam by ESA Trader because the money is NOT with them, it is between you and FXDD, for your information, FXDD is about to be regulated by NFA.
BUT, you will have the risk of losing money, IF the EA not perform well. Please do not blame ESA Trader as I believed they tried their best to make the EA to perform. Forex trading is NOT for everyone UNLESS you know what is RISK MANAGEMENT.
TAKE NOTE, ESA trader made money for every trade that the EA have entered, they will charge you USD6 no matter that particular trade win or lose, that is their business model and they earn money from there. As a return, they will make sure the EA can earn money or else they will bankrap.
3)I pitty real Andy, the CEO of Esa Trader, I suggest you to do the following in order to save your business:

KY, if you have not noticed, you have only antagonized yourself and nobody else. What you said publicly only reflects your state of mind and maturity. I am not bothered by what you said and not even bothered to return to this blog. I came to seek the truth to find if there is any proof that my money can be cheated by FXDD and ESA Trader – I too influenced by rumours. I was very concerned if JP is behind ESA Trader. I have not found any clue of fraud yet. I even spoke to FXDD about PAMM and they confirmed its their systems to put in bigger lot of order and later redistribute to the many investor according to their equity participation. Simple as that. Not a system invented as some claimed to cheat the investor of their money. I had a good laugh after I found the truth from FXDD.
Those who wants the truth can always go to FXDD.com website and od a live chat with them and ask them any question. Now that my money is safe I dont care who is behind the company.Thats is my personal choice and opinion and I dont encourage anybody to follow my decision.
I will not put the good educaton my parent gave me to waste by engaging in public debate using unkind wowords. My intention is noble to tell the truth as least from my side of the experience. If there are
others who have different experience they should tell share their experience and not make wild allegations.

I came to theis blog to find out any proof of fraud or cheat by FXDD or ESA Trader. I didnt read any that prove that – just wild allegations, hearsay and sinister plot to destroy ESA because of perceived JP involvement. I dont know really if JP is involved. I want to see proof of fraud then I stop my investment. Right now we have been able to withdraw money on our own free will even without consultation with ESA but of course in doing so we face the danger of hitting margin call but really, nobody can stop you withdrawing your money. My friend asked me to show account that loses money. I want to but there is any. There are those who lost money in the first 2 week consecutively hit with 3 tmes 300pips loss, invested $4000 lost $3,600 but at the end of 6 weeks still profitted 120%. So those who said lost money in first week or second week did not tell the whole story. Or it is NOT EVEN their story so they dont have all the facts. For me who dared to write, i can show the proof. Forex is high risk investment. On my own, I lost 100% in 3 days. On Robot Trade I made money everyday – how lucky can I be. Again, I have no business to defend ESA Trader but I offer a balance, fair view and the TRUTH. For those who were cheated stay away from any kind of big return investment and you will be safe – especailly those that you have to hand money over to a company you hardly know nor established. ESA do not handle my money, just my trade. FXDD is big and if it has to go bankrupt like Lehman Bro then,just my luck, what to do?. So we keep withdrawing our profit as we profitted. Many of us already got 50-100% of our capital back. We all have to pay in one way or another for our wrong doing. So again, its not easy to forget the bad experience of being cheated especially if it made you in heavy indebtedness or bankruptcy. But if you forget and move on, you probably get better energy to do well in your life not to let the past to continually haunt you. You paid the prize, now benefit from the lesson. Not to pay even more prize by suffering mentally and emotionally.
Let me state my position so that my comments can be digested with an open mind and fairly – not for any particular group of person’s benefit but for those who are objective. I am just an investor with ESA Trader who joined with a group of about 20 other friends. I turned my friend away when first asked to listen to what ESA Trader has done for them giving them phenomenal profit. My first reaction is anything with such impressive return must be a scam or fraud. It was until another friend approach me one month later that I decided to go and listen to the proview with the sole objective of ‘saving’ my friend from this scam. I personally paidRM4,900 to attend one of the top Forex class in town and has benefitted and learnt a great deal about Forex,all except making profit. My fellow students had similar experience – sound knowledge but we cant make money. After the preview, I was thinking how could ESA practice of 300pips stoploss which is totally against what our trainer taught us cold possibly make them money. So a group of us tested it out on demo accounts and bingo we made money. With that confidence and further discussion amongst us that neither FXDD or ESA Trader could in anyway cheat us of our money, we decided to give it a shot since the amount involved isn’t too big – I have already lost that much on my own trade anyway. We profitted anything from 20-98% within 1 month. Nobody in my group losses any money – just some profit more and some less. These are truth, not hearsay or wild allegation. I have no business to defend or promote ESA but I symphathise with those bent on destroying this company bcoz of their anger with JP and by extension their assumption of ESA with JP. I dont know who JP is but as an investor we did our due deligence. We checked out FXDD, We confirmed with friends who withdrew money that they got it back into their account within 3 days. ESA Trader only has control over our trading which could be stopped anytime. Whoever JP is and if it were true he is behind ESA Trader, personally it does not bother me so long he has no means of cheating my money. As soon as performance falter or dropped, we will terminate ESA service asap. I never get myself involved with those big return stuff promised by Sunshine Empire or Gold outfit – I never believe that return can be that good for an operation we cannot understand. But I believe in Forex and ESA is just a oonvenient and reliable vehicle for now. The momment they cannot perform, we terminate their service. As for fraud, I hope somebody can elaborate how FXDD or ESA can cheat their client in this Forex deal. Seriously I want to know, not just some wild allegations or personal opinion. I repeat I have no business to defend or promote ESA, at least not to you people whom I dont know. But i do promote to my friends and family whom I care about to make that extra cash which turn out to be very lucrative actually. For those who were cheated, let that be a lesson well learnt and let the authorities deal witht he culprit. Get on with your life and do not harbour any anger or you will let real opportunities pass you by in future just because of one bad experience. I paid a big prize myself in the 1993/94 and 97/98 and 2001 Stock Market crash. We grow we learn and I hope those who suffered, learnt too. When you curse someone, you built up alot of negative energy which is not good for health or your mind.

Just a piece of cautionary advice to everyone ‘playing’ in EsaTrader…please note that recently they are coming up with all kinds of new rules and regulations like even imposing a quota on Malaysian traders by not allowing them to join as from the first Dec 2009 but only opening up to them again from 2010 onwards.Why should someone in business like Esatrader turn to imposing quotas when every new business from every corner of the world should benefit them….think about this and be weary and also be cautious about their excuse with every new development they announce on their website that they are working round the clock to overcome this and that problem, that always seem to crop up. How can like this?
I dont know who James Phang is and obviously alot of people sore with him for being cheated. There are poeple who linked ESA Trader with JP. But my personal experience with ESA Trader and my knowledge of Forex has been these. My money is with FXDD, not with ESA Trader so there is no way it can scam away my money. They survive on making profitable trades for me and they have been doing so. I have with me accounts of more than 15 people who joined my group – we made average of 20-985 within 1 month. Thats a sterling performance by any standard for Forex. If its fluke that they can do so I take my hats off. I went to Forex school paid $4900 and lost almost 100% of my money. In the last month, I invested $3000 with FXDD and asked ESA Trader to trade and made 70% in one month and this is the truth. One fren made 35% in 1 week. Automated Forex trading is very common in the net and ESA Trader has been very good or very lucky to get all my friends to make profit this first month.
I wish somebody can expose the scam to me….I still cannot see it.

what’s wrong with you guys?
If you are talking about PAMM account from fxdd,i have been using it for some times to manage my client’s fund.
It’s a common methodology being implement by master forex traders.
You guys new to forex?
I am familar with PAMM.
1.Do you know as long as there are floating losses, the client signed under PAMM will not able to withdraw money until the master account closes all trades. You no longer can stop the account from trading as before.
2.And it also means that all accounts under the PAMM has one single entry and exit points. This is dangerous as the broker can play them out with visible pending stop losses.
3.Eventhough, over a 3 to 6 month period, on an average the ‘fund’ has been doing well. But this is on the average, meaning if your friends come in on the month that is losing money… let say 40% losses, it will take the fund to grow closes to 70% the following month to get it back to 100% again as the fund has shrinked.

Q What is the status of the investigation?
A CAD has completed the investigations on Sunshine Empire Pte Ltd (“Sunshine Empire”) and other companies involved in this case. On 3 February 2009, the following persons have been charged in the Subordinate Court.
a. Jackie Hoo Choon Cheat, a director of Sunshine Empire, and James Phang Wah each faced 1 charge of fraudulent trading under Section 340 of the Companies Act, 1 charge of failure to maintain proper accounting records of Sunshine Empire under Section 199 of the Companies Act and 8 charges of criminal breach of trust as an agent of Sunshine Empire under Section 409 of the Penal Code;
b. James Phang Wah also faced 6 charges of falsification of Sunshine Empire’s accounts under Section 477A of the Penal Code and 1 charge of false declaration of the share capital of Empire Communications Technology Pte Ltd under Section 401 (2A) (b) of the Companies Act. In addition to the Penal Code and Companies Act charges, James Phang Wah faced 3 charges for possession of uncensored and obscene films under the Films Act;
c. Neo Kuon Huay, a director of Empire Emall (S) Pte Ltd, faced 6 charges of falsification of Sunshine Empire’s accounts under Section 477A of the Penal Code and 1 charge of false declaration of the share capital of Empire Emall (S) Pte Ltd under Section 401 (2A) (b) of the Companies Act; and
d. Yong Wai Hong, a director of Empire Communications Technology Pte Ltd and various companies, faced 6 charges of false declaration of the share capital of various companies under Section 401 (2A) (b) of the Companies Act.
Note that Yong Wai Hong has already been convicted of the charges under the Companies Act.

Sunshine Empire trial
The trial of the bosses of the Sunshine Empire has just started. James Phang, his wife Neo Kuon Huay, and ex-direcror Jackie Hoo Choon Cheat have been charged with their roles in this affair.
The prosecution has alleged that they masterminded what is Singapore’s largest Ponzi scheme involving more than $180 million. Ponzi schemes are a scam where monies from new investors is used to pay off previous investors, thus giving the appearance of a successful business model.In this way, more investments are attracted.
Ponzi schemes have been in the news in the last 12 months because of the enormous scam run by American Bernie Madoff. Please search this blog if you want more information on some of Madoff’s tactics.

When SE held their convention in Genting means that Genting belong to James Phang too? I also see many members from different MLM company so does it mean that James Phang owned them all? majority people here were saying of what 40% of ESA traders staff from SE, and a lot of figure work, but i am wondering that these statements have not evidence, everyone just saying it is a scam but DR andy has mentioned of ESA trader is not a broker but only a service provider of their autotrading software,sincere hope people around here read the comments chariness and without bias

I actually did some checking and I found out that James Phang DOES NOT belong to ESA Trader.Sunshine Empire was his and people like him who scam other people’s money wil surely have their retributions.
I also checked on Terry Tan.He DOES NOT work for Sunshine Empire.I don’t know if he was a victim of Sunshine Empire(as in those who invested) but I checked he is now a student of Esa Trader.He also DOES NOT work for Esa Trader.But he is one of those who invested and believe in this automated trading platform,and spreading the word around to his friends,which is similar to being an Account Advisor.But he definitely DOES NOT hold any share with Esa Trader group of directors.

As such a corporate and experience guy, I am very curious why you say that you do not know who Terry Tan was?
My opinion – it is very little chance that FXDD will con you as they are quite a well known Forex broker.
As for ESA Trader, SaaS is quite a lucrative business model no matter traders win or loose. The key is sustainability! In order to sustain their business, the only choice is to make money for their clients. And this is not an easy job especially the size of the fund become bigger and everybody placing the same trades. FXDD is a broker and size does matter to them. They are acting as a middle platform and trade against their clients. If the EA perform well, they have plenty of tricks to apply. One of them is to increase the spread and re-quote. This is the problem with FAPTurbo when it become mass marketed. That’s why FAPTurbo come out with Evolution version that trade only with Dukascopy (ECN, not broker). And the original version become fully flexible with many adjustable variables so that traders can adjust to perform better than their default settings.
As for marketer of ESA Trader, the commission is depend on the sustainability issue.

It makes me wonder why they choose such a bad reputation broker, and why? because they are not regulated by any body as well.
I have friends in Hong Kong, and I’ve get my friends to check out their so called “incorperated” in Hong Kong office (the one stated on the website), and it turns out that the office is non-exist. It is a virtual office. For those who don’t know what is virtual office, go search it. it means they “rent” a “company address” just for the put the company name there, but in actual, they do not have office. it’s something like Imaginary Office. After i hear that, i check all the other so called address of other office in china, singapre, and thailand, ALL ALSO VIRTUAL OFFICE!! which means, this “company” have NO office AT ALL! they are all just empty shell!
go search their address, you will see a lot of comapany, also using the exactly same address,
because why, they also rent the same address!
So it means that if you got a problem, suddenly they disappear, and you thought u still can find them in the office, and you will end up no place to go to, BECAUSE IT NEVER EXIST.
AND that is not the worst yet, the so called “FINANCIAL Broker” the NZ Finance, ALSO VIRTUAL OFFICE, How in the hell a real financial broker can function even without a proper office???
So think again if you think you want to invest in this company

For your information, we are renting Regus serviced office. You may go to http://www.regus.com/ instead of google search. We are using their service since most of the corporates are using them (eg. Intel, BT, Nokia etc.). We believe in their reliable services.
You have to understand, we are the software as a service (SaaS) provider. We do not need a huge corporate office. Our business is very transparent as it is based on pay per use basis. Anyone can stop their auto trading at any time and there will be no more charge. Perhaps it is new to the market on this concept.
Your comments let me think of Lehman Brothers, Barings Bank etc., they have huge presence and offices worldwide, but what is happening to them now.
Regarding NZ Financial, it is an offshore finance company, it is normal for offshore finance company to use serviced office since usually offshore finance companies only serve high net worth clients with strict confidentiality. They do not do retail businesses. This is the pre-requisite for that. We have been doing a lot of negotiation with NZ Financial to be associated with ESA Trader. If anyone has any doubts in their services, please let us know.
Just to clarify your statement, we DO NOT employ SE and emmax (though I personally do not know what companies are they) people to do marketing, our model is based on rebates. Anyone can do it.

In fact, FabTurbo is one the best EA that I come across. Allow me to rectify your statement, we DO NOT sell out EA. The guy who told you to sell to your contacts is not technically right. Our business model is based on traded lot commissions and also very minimum amount of basic training.
1. Regarding the website, we are not focusing on our management staff but more focus on what services that we could offer. I understand that some companies tend to put their management information in order to attract investor to invest in their companies. We are NOT. In addition, there are many parties out there trying to headhunt our staff. We are trying to protect our own interest. Have you ever seen Intel, BT, Nokia publish their key people onto their website? Our business model is based on traded lot commission. In fact, you are right, FapTurbo is one of the good EA that I come across. I will encourage people to try it if possible.

2. MLM? We just purely give out rebates from part of the commissions. Not sure whether you are aware that even unit trust agents are enjoying 4 to 5 tiers commissions rebate but why we do not classify them as MLM? Are you suggesting that we should change this marketing strategy? Do you have any better idea then I am willing to listen.
Participation in competition is really good for publicity. In big hedge funds like the one managed by George Soros, they have something called a BLACK BOX for capital market which is highly secured. They do not go for competition, right?
I have been experiencing various competitions in R&D activities up to even wining the Frost & Sullivan R&D Awards for British Telecom (BT) in 2008 but many of such competitions are not really meeting the business needs.

According to my friend, this platform is giving guaranteed profit of 0-15% a month, mean no loss, marketers will get 10-20% commission from collected fund. They have a strong statements show in pdf file but no live statement. When my friend show me their performance chart, it grow from 0 capital to extremely high profit.
